RULES ON TOWING OF ACCIDENT VEHICLES
  1. To collect fees according to the charges fixed by the Association.
  2. Towing on "First come first tow" basis, that is, if not more than (five) cars met with a single accident, if the "workshop representative" of a workshop is at the scene of accident, the other "workshop representative" who arrived later will have to leave the scene immediately. Unless if the car owner is a regular customer of the second workshop, and the said "workshop representative" shall intervene with the consent from the car owner. If there are (six) cars involve in a single accident, then the second "workshop representative" of a different workshop who reach the scene later would be allowed to deal with one car owner. If there is no other "workshop representative" present, then the first workshop whose "workshop representative" is present will tow all the vehicles. Note: The number of vehicles in bracket shall be decided by individual State Association.
  3. If the car owner insist to wait for his own choice of workshop, in which case the "workshop representative" arrived at the scene shall not threaten the car owner.
  4. The "workshop representative" of workshop shall not indulge in promises or approach the car owner for coffee money of any kind or to cheat the car owner. Any "workshop representative" found guilty of the above offences will be dismissed from the workshop.
  5. Workshop operators shall not provide protection fees of any kind to any person, in case of compilation; it shall be referred to the police and no other workshop shall intervene.
  6. If the vehicle from outstation met an accident in any other state, and the car owner insisted to have his or her car tow to the original state, the "workshop representative" shall not trouble the car owner.
  7. Any "workshop representative" who arrives at the scene of accident and found that there is a "workshop representative" arriving earlier, he is not allowed to converse with the car owner and shall leave the scene immediately, unless the car owner is the customer of the workshop and the car owner has given his consent.
  8. "First come first tow" only apply on the "workshop representative" who has registered with the Federation and not any other representatives of workshops. If a workshop owner do not have any "workshop representative" and he wish to carry out the duty at the scene of accident, then the owner of that workshop shall register with the Association where he is allowed to involve.
  9. The workshop concern shall obtain the approval from the car owner by signing the "Authorization To Tow" form before towing the vehicle. In the absent of the car owner, signature of the driver must be obtained.
  10. When the car owner gets into the car of a "workshop representative" of any workshop (AAM or regular) shall proceed with intervention. If the car owner with to tow the vehicle to other workshop, this process shall be carried out in the workshop according to the conditions of the towing scheme.


CHARGES
  1. "Total Loss Vehicle": A flat rate of RM 800.00 (inclusive of towing charges, estimate fees and other service charges but excluding storage charge)
  2. Storage charge: Free for the first 14 days, and covered RM 10.00 and uncovered RM 5.00 for the subsequent days.
  3. "Non-Total Loss Vehicle", the charges are as follows:
       - Comprehensive cover: RM 500.00
       - Third Party cover: RM 250.00
    Charges stated above inclusive of service charge, storage charge and towing charge. (These charges have to be bear by the workshop concerned and not the car owner, and no receipt has to be issued)
  4. Towing Charge: First 10 km, RM 60.00 and RM 2.00 for each subsequent km (from 7.05 am to 7.00 pm) and towing from 7.05 pm to 7.00 am, an additional of 50% would be imposed.
  5. In case of using of more than two tow trucks or crane, extra cost will be charged accordingly.
  6. Vehicles which are towed to the Police Station without the approval from the owner. A standard fee of RM 100.00 will be charged. (to be paid by the workshop receiving the vehicle)
  7. For vehicles which can be driven, when the car owner wish to take out the vehicle, and if the workshop concerned had assist in making Police report or preparing repair estimate, a maximum rate of RM 200.00 would be charged. If nothing has been done, there should not be any charges.
  8. If the Association receive complaint of any violation on the above, on investigation and found that the workshop is guilty, the workshop concerned will be given 14 days to resolve the matter, failing which the workshop shall face the action as stated in Rule A.


CONDITIONS ON TOWING OF ACCIDENT VEHICLES & TOTAL LOSS VEHICLES FROM ONE WORKSHOP TO THE OTHER
1) The Federation does not encourage towing of accident vehicles from one workshop to the other' with the exemption of the following conditions:-
  1. The car owner decided to have his or her choice of workshop to repair the vehicle, in which the first workshop who towed the vehicle shall release the vehicle and collect the fees fixed by the Association (to be paid by the second workshop). The second workshop is not allowed to employ "dirty tricks" to have the vehicle towed out of the first workshop. On conclusion, if a vehicle is towed out from one workshop and landed at the other workshop, the later who received the vehicle shall be liable for the charges.
  2. On release of the vehicle, the first workshop must assure that the vehicle is in its original condition, no parts should be removed or damaged. Any workshop found violating this rules shall be liable to the necessary compensation.
  3. Under the above conditions, it is the duty of the car owner to approach the workshop to complete a standard form before the vehicle can be released. In case of dead or critical injury to the owner, then the close relative shall assist in this matter.
  4. On receiving request from the car owner, the workshop owner or its executive shall release the said vehicle within three working hours. Working hours shall be from 8 am to 5 pm, excluding public holidays. And during Chinese New Year, these dealings shall resume after the ten days of Chinese New Year.
  5. The request to release any vehicle shall be brought up within five working days after the accident, after which it will not be protected under this scheme. This does not include cases where car owners are from outstation or dead or critical injuries occurred due to the accident.
  6. None members who wish to tow a vehicle out of a members' workshop shall abide by the regulations stated under the "Towing Scheme". If they refuse to do so, their workshop will be black-listed and would be prevented from joining the Association for life.

2) On "Total Loss" vehicles, if the original workshop do not or failed to purchase the vehicle and it was purchased by other workshop. The first workshop shall give its fullest co-operation to release the vehicle and collect the towing and storage charges fixed by the Federation.

On release of the vehicle, the first workshop shall assure that the vehicle is in its original condition. No parts shall be removed or damaged; any workshop found violating this rule shall be liable to the necessary compensation.
